Introduction

Catch Sport (“Catch Sport”, “we”, “us”) was established with the purpose of bringing athletes and sponsors together in a mutually beneficial relationship. We will match up athletes looking for funding with organisations which have a budget for sports funding.

The service is aimed at athletes of all ages from all sports, and at corporate sponsors from all parts of the UK.

Catch Sport will, using data provided by users of the service, match sponsors and athletes according to each party’s needs and preferences. Catch Sport will charge a commission fee where a successful match is made.

This document sets out the terms under which Catch Sport will provide the Catch Sport sponsorship matching service (“the Service”)

This website is owned by Catch Sport Limited, a company registered in England and Wales (company number 5638366). The use of the Catch Sport.com website (“the Website") is subject to the following terms and conditions. By using the Website, you agree to these terms of use.

Once you have completed the online registration procedure and your membership has been activated, you will be bound by these Terms & Conditions for the duration of your membership. Please read these terms and conditions carefully.

1. General

1.1 The Website, its design and contents are all © Catch Sport Limited 2006.

1.2 Catch Sport grants individual users of the Website a non-exclusive personal licence to view and copy the material on the Website solely for personal and non-commercial use.

1.3 Catch Sport has the right to revoke this licence at any time and without notice.

1.4 You may not reproduce material on the Website other than in accordance with this licence and, without limitation, you may not copy or reproduce any information on the Website on any other website or in any other form.

1.5 You agree not to arrange for any other website to be connected to the Website by way of hyperlink or by any other means without the prior written consent of Catch Sport.

1.6 Catch Sport has the right to revoke such consent at any time and without notice.

1.7 Catch Sport reserves the right to change these terms of use at any time without notice. Any such changes will be displayed on this page of the Website.

1.8 Catch Sport reserves the right to modify, suspend or discontinue any part of the Website and the services offered therein at any time without notice.

1.9 Catch Sport shall not be liable to you or to any other person in the event that all or any part of the Website is discontinued, modified or changed in any way.

1.10 You agree not to upload or transmit through the website anything designed to interfere with, interrupt or disrupt the normal operating procedures of a computer, including (but not limited to) computer viruses, macro viruses, Trojans and worms (in this Agreement, collectively known as “Computer Viruses”).

1.11 Catch Sport will use reasonable endeavours to ensure that the website is free from such Computer Viruses, but Catch Sport makes no warranties that the site is and will be free from such Computer Viruses, and accepts no responsibility for any loss or damage sustained by you as a result of your use of this site.

1.12 You agree not to use the Website for any illegal or immoral purpose.

1.13 You further agree not to upload any material which is deemed by Catch Sport to be defamatory, offensive, of an obscene or menacing nature including, but not limited to, material which is racist, homophobic or sexist, or which could in any way offend, annoy or inconvenience another person.

2. Registration, Scope & Use of the Service

2.1 Athletes may register with the site at no cost as an ATHLETE and £495 (+VAT) as a SPONSOR.

2.2 Sponsors will be charged a subscription fee to register with the site and gain access to anonymised information about Athletes in accordance with clause 2.9 below.

2.3 You agree to submit and maintain accurate and up to date information in your online profile.

2.4 Athletes - Catch Sport will not allow other users of the service to see your online profile in a manner that relates it identifiably to you without your subsequent prior consent, and in accordance with clause 3 below. Catch Sport will enable potential Sponsors to search for Athletes looking for sponsorship using anonymised general information. The Sponsor will only be able to see how many athletes meet their sponsorship criteria and what sport(s) those athletes compete in. Click here for example. If Catch Sport is successful in matching your requirements to those of a sponsor that sponsor will be supplied more detailed information about you and other matched athletes.

2.5 Sponsors – Catch Sport will not allow any other users of the service to see your online profile without your prior consent. To the extent that Catch Sport successfully matches your requirements with those of athletes registered with the Catch Sport service you will be supplied with certain details regarding such athletes for the purposes of considering a matched sponsorship. Insofar as such information is made available to you you agree that you will abide by our privacy policy in respect of any such information.

2.6 Once you have registered for the Service, Catch Sport will use its best endeavours to match you with an appropriate sponsor or athlete, depending on your needs, and in accordance with clause 2.3 above and clause 3 below. Catch Sport cannot guarantee to successfully match you with an appropriate sponsor or athlete.

2.7 You are responsible for maintaining the confidentiality of the username and password that you designate during the registration process.

2.8 You agree not to conduct yourself in such a manner which is or can be construed as being defamatory, derogatory or disparaging of Catch Sport or its products or services or otherwise adversely affect any advertising or promotional campaign of Catch Sport.

2.9 You agree to notify Catch Sport immediately if you know or suspect that there has been any unauthorised use of your username and/ or your password.

2.10 Sponsors - You acknowledge that Catch Sport will charge:

2.10.1 an annual subscription fee (“Subscription Fee”) of £495.00 plus VAT, payable in advance, to enable you to gain access to anonymised information about Athletes seeking a Sponsor.

2.10.2 a management fee (“Management Fee”) for arranging a contract with your chosen Athlete(s) in accordance with Catch Sport’s standard rate card of charges from time to time.

2.11 Sponsors – you acknowledge that the Management Fee and the Subscription Fee are non-refundable.

2.12 Athletes and Sponsors acknowledge that Catch Sport’s role is limited to marketing and Catch Sport will not be liable to any person for any breach of any agreement entered into between any Athlete and Sponsor.

2.13 Catch Sport reserves the right to review the Subscription Fee and the Management Fee from time to time and further reserves the right to increase the charges upon reasonable notice.

2.14 All Catch Sport invoices are payable within 7 days of invoice date and late payment will attract interest at the rate of 4% over base lending rates from time to time. VAT if applicable will be payable in addition to all sums invoiced by Catch Sport upon presentation of appropriate VAT invoice.

2.15 Upon any failure to make payment of any invoice you will have no right of reduction set off or counterclaim and shall not be entitled to question or dispute any invoice rendered by Catch Sport unless you have notified Catch Sport of the same in writing within 28 days of invoice date.

3. Privacy policy

4. Registration

4.1 Under the Consumer Protection (Distance Selling) Regulations 2000 (as amended), you are entitled to postpone commencement of the Service until the end of a seven day “cooling off” period. However, by registering for the Service and using the Website, you are electing to commence the Service immediately and you therefore waive any right to cancel the Service under the above regulations.

4.2 You may remove your details from the Service at any time or for any reason whereupon such removal will be without prejudice to any obligations you might have pursuant to matching agreements entered into prior to that date. Once you have notified us in writing of the removal of your details we undertake not to forward your details to any further sponsors or other parties.

4.3 If at any time you are in breach of these Terms & Conditions, we may terminate your registration upon reasonable written notice. To avoid doubt, written notice also includes notice via email.

5. Indemnity

You agree to indemnify, defend and hold harmless Catch Sport from any and all losses, liabilities, claims, damages, expenses or costs asserted by any third party in connection with your use of the Website.

6. Limitation and exclusion of liability

6.1 Catch Sport endeavours to ensure the accuracy of all content of the Website. However this cannot be guaranteed and Catch Sport's liabilities are excluded and/or limited as set out below.

6.2 You agree that the Website is provided on an "as is" and "as available" basis without any representation or endorsement from Catch Sport.

6.3 Catch Sport makes no warranties of any kind, whether express or implied, in relation to the Website or any services or products offered therein. This includes, but is not limited to, any products or services offered by any third party.

6.4 The content of the Website is provided for information purposes only and you should not rely upon it in making or refraining from making any decision or in taking or refraining from taking any action.

6.5 You agree that your use of the Website is entirely at your own risk.

6.6 Catch Sport hereby excludes all and any losses, liabilities, claims, damages, expenses or costs (whether as a consequence of its negligence or otherwise) arising in connection with:-

6.6.1 your use or inability to use the Website or the services offered from time to time therein

6.6.2 any unauthorised access to or alterations of information provided by you

6.6.3 your use of any third party websites (including without limitation those that may be connected by hyperlink to the Website)

6.6.4 any arrangements entered into with any third party in connection with any information provided by or in connection with the Website

6.6.5 the inaccuracy, incompleteness or tardiness of any information supplied through the service

other than, in each case, any liability in respect of death or personal injury.

7. Advertisements and links to other websites

The Website may contain links to and content from other internet sites and resources. Catch Sport cannot control such content and you agree that, without limitation of the terms set out above, Catch Sport is not responsible for such content. Catch Sport cannot endorse products or services offered by third parties through such content.

8. Your consent

By using the Website, you agree to these Terms & Conditions in full. You understand and agree that these terms of use constitute the entire agreement between Catch Sport and yourself in respect of your use of the Website and the Service and supersede any and all prior arrangements, agreements and representations.

9. Governing law

These Terms & Conditions and your use of the Website are governed by and construed in accordance with the laws of England and Wales and the Courts of England and Wales shall have exclusive jurisdiction to determine any dispute in connection with such terms or use of the Website.
